Specifically, this study will be identified the rationales and consequences of ISDs stem from changes in host states’ climate change policies and laws, and which principles or rules under international law (focus on international investment law) can balance between investment liberalization and environment protection on the disputes.
-The Paris Agreement is a legally binding international treaty on climate change, which was adopted by 196 Parties in 2015. The countries should submit their climate action on a 5-year cycle known as nationally determined contributions (NDCs). As a result, according to the latest Intergovernmental Panel on Climate Change reports, the states’ climate change measures have been strengthened. This situation is likely to surge in investment claims with environmental components.
