This project aims to study what provisions and chapters are needed to integrate climate-change mitigation into IIAs more specifically. Specifically, this project will define vague conceptual positions in IIAs that might frustrate state’s climate-change measures. On the basis of this, the project will analyse how states consider those fluctuate positions to protect their policy power when signing a new IIAs or revising the current IIAs.
-This approach seems more realistic. Even though sustainable development regulations have not introduced in IIAs, arbitral tribunals can integrate non-economic values in investment disputes by interpreting the case reasonably.
